The Rutgers Institute for Professional Education is offering a program from 5 – 8 pm on Wednesday, October 12, 2011, on key recent U.S. and New Jersey Supreme Court criminal procedure decisions that announce changes in the law, clarify major changes from prior cases, or indicate coming significant changes. Rutgers IPE, a partnership between the Rutgers law schools in Newark and Camden, is offering the program at Rutgers School of Law–Newark.

The program will be taught by Rutgers School of Law–Newark Professor George C. Thomas, a nationally–recognized scholar on criminal procedure, and Ronald Susswein, an assistant attorney general in New Jersey and expert on criminal procedure issues. Discussion will include the holding in each case, divergence between federal and state law, practice issues that arise from the holding, and implications for future doctrine. 

Among the cases to be covered are:

• Shatzer v. Maryland, 2010 U.S. Supreme Court Miranda case involving a 14-day break in custody
• Padilla v. Kentucky, 2010 U.S. Supreme Court case involving defense attorney duty to inform non-citizen clients of potential deportation consequences of a criminal plea
• Berghuis v. Thompkins, 2010 U.S. Supreme Court Miranda waiver case confirming the notion of waiver by action that had been implied in previous Court decisions
• Herring v. U.S., 2009 U.S. Supreme Court Fourth Amendment remedy case following the path begun in U.S. v. Leon limiting the exclusionary rule
• State v. Pena-Flores, 2009 NJ Supreme Court case restricting the automobile exception in New Jersey constitutional jurisprudence.
