Statement From Rutgers School of Law–Newark on Decision in Sussex Commons Associates v. Rutgers University
October 25, 2010 –We are disappointed in the decision of the Appellate Division. As we argued before the Court, we believe that subjecting the client and teaching files of our law school clinics to the New Jersey Open Public Records Act will make it more difficult for our clinical program to carry out its mission. As a result of today’s decision, our clinics and our clients may be treated differently from every other legal service provider in New Jersey, and our adversaries will be able to pursue discovery outside of the normal rules. The Legislature could not have intended such an absurd result. We are considering all of our options in light of this ruling.
